§ 1 Scope and provider

The provider and contracting party is Exoteninsel, represented by Simone Thomas. FloraSpotter includes, among other things, map spotting (including geocaching layer, urban gardening/parks & community gardens, optional EXIF photo upload and location-based plant radar), Garden Navi (GPS-assisted guidance in your own garden), world route planner, AI plant identification, digital collection, care features, expert tools and a community exchange.

§ 2 Free account and FloraSpotter PRO

§ 3 Digital subscriptions (PRO) — term, renewal, cancellation

FloraSpotter PRO is a digital subscription for digital content or digital services not supplied on a tangible medium. The subscription renews automatically for the selected term (month or year) unless cancelled beforehand. Billing is via Stripe; invoices or payment receipts are provided via the payment provider or by email where customary.

You may cancel your FloraSpotter PRO subscription at any time effective at the end of the already paid period — in particular with one click in account settings. After effective cancellation, PRO access remains active until the paid period ends; no pro-rata refund of amounts already paid for the current period is made unless mandatory law (e.g. withdrawal) requires otherwise.

After expiry without renewal, PRO features end (including Expert Tools and exact public navigation); your stored content generally remains, but then again under Free quotas and restrictions.

We announce price changes for future periods with reasonable notice. For the current already-paid period the price applicable at period start remains decisive unless otherwise agreed or mandatory law requires otherwise.

§ 4 Registration and user obligations

A user account is required for cloud features. Information must be truthful; access credentials must be kept confidential. You undertake not to post unlawful content and to respect third-party rights and species protection rules.

§ 5 Rights of use in content; location and navigation aids

By uploading content (photos including any EXIF/location metadata contained therein, texts, location details) you grant Exoteninsel a non-exclusive, worldwide, royalty-free right to use such content to operate, display and improve FloraSpotter (including AI analysis and map placement). You warrant that you are entitled to do so and do not infringe third-party rights.

Location-based alerts (plant radar/vibration) and GPS-assisted Garden Navi (including distance and compass display) serve solely as technical aids for private or commercial gardens or for orientation. They do not replace care in traffic, outdoors or on terrain, nor your own assessment of terrain hazards.

Garden Navi / location measurement disclaimer: Measurement inaccuracies, deviations of GPS, distance or compass values, terrain obstacles, and any missteps, trips or other harm while using the feature outdoors are your responsibility. To the extent permitted by law, we exclude any liability for such consequences. Mandatory statutory liability rules and liability for intent and gross negligence remain unaffected.

Technical signals: Acoustic signals (e.g. sonar pulses) and local vibration triggers (where supported by the device) serve solely for on-device navigation / orientation and are generated locally on your device. Details on processing are in the privacy policy.

§ 6 Exchange marketplace

The exchange marketplace facilitates contact between users. Exoteninsel does not become a party to individual exchange or purchase transactions and assumes no warranty for quality, health or identity of plants offered. Transactions are at the parties’ own risk.

§ 7 Expert Tools, AI and automated care calculations

FloraSpotter optionally provides automated guidance, in particular in Expert Mode via the Fertilizer Engine (NPK/substrates), the Light Assistant (lux/PAR and placement analysis), volume/pot estimates (LiDAR or AI photo), hemisphere- or season-related care windows, and AI-assisted species and health analysis. These features serve solely as non-binding decision aids / non-binding guide values for hobby and professional users.

All calculations, NPK recommendations and light analyses are not a binding professional commitment. Results are based on models, user inputs, sensor data and estimates and may be incomplete, incorrect or unsuitable for the specific location. They do not replace professional advice from horticulture, agriculture, plant protection or veterinary/agricultural science, nor local observation of the plant.

Disclaimer / no warranty: To the extent permitted by law, we assume no liability and give no warranty for plant health, yields or the success of care measures, nor for damage to plants, substrate, property or other financial loss arising from applying or not applying automated fertilizer, light, volume or care guidance — in particular over- or under-fertilization, incorrect watering, unsuitable substrate, faulty sensor/photo evaluation or differing site conditions. Mandatory statutory liability rules and liability for intent and gross negligence remain unaffected.

You undertake to check recommendations with your own care and experience and to seek expert advice if unsure. Use of Expert Tools is at your own risk.

§ 8 Availability and liability

We strive for stable operation but do not owe uninterrupted availability. In cases of slight negligence we are liable only for breach of essential contractual duties and limited to foreseeable, contract-typical damage. Liability for intent, gross negligence, injury to life, body or health and claims under the Product Liability Act remain unaffected. For automated care and fertilizer calculations, § 7 applies in addition; for Garden Navi and location measurements, § 5 applies in addition.

§ 9 Changes to the Terms

We may adjust these Terms where required due to changes in law, new features or factual reasons. We will notify material changes in good time. If you do not object within a reasonable period, the amended Terms are deemed accepted; we will point this out separately.

§ 10 Withdrawal information for consumers

If you are a consumer within the meaning of § 13 BGB (German Civil Code), you have a statutory right of withdrawal for paid contracts concerning digital content or digital services — in particular the digital subscription FloraSpotter PRO. Details on term and automatic renewal follow from § 3.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a consumer, mandatory consumer protection rules of the state of habitual residence remain unaffected. If any provision is invalid, the validity of the remaining provisions is unaffected.
